Kennedy Guy update – September 2020


Kennedy Guy is open and continuing to assist clients during COVID-19 and the recent lock-down measures.  Our lawyers are available to obtain instructions and provide advice by telephone or video conference.

Wills and Estates

Our Wills and Estates team is able to assist with preparation of or advice regarding Wills and Powers of Attorneys.  Our team is available to obtain instructions by telephone or zoom conference. The signing of these documents can be managed remotely, if needed.

We are also able to continue to manage and administer deceased estates, including obtaining Grants of Probate, as the Supreme Court Probate Office now operates online.

Family

If you have a family law or family violence enquiry, please contact our office to speak to a family lawyer.  We are still operating to assist clients with negotiating property and/or parenting matters, formalising parenting or property settlements, making applications to court for parenting and property orders, and in respect of family violence applications.

The Family Court of Australia and Federal Circuit Court of Australia continue to operate and can hear parenting and property matters, with court hearings occurring through telephone or video conferencing.

For people experiencing family violence or responding to a family violence application, the Magistrates’ Court continues to operate to hear those applications.

Business and Commercial

Whilst some businesses are operating at reduced capacities due to the Stage-4 lock-down restrictions, it is still business as usual for us (save for having to work remotely).

We have been continuing to assist our clients with their commercial transactions, such as sale and purchases of businesses, transfers of shareholdings, loan agreements and leases. We are also continuing to provide advices in relation to all commercial matters, including employment law, tax advice and commercial agreements.

The current economic outlook has also prompted many business owners to review their business structures and we have been assisting our clients with reviewing their business structures to ensure they have the greatest asset protection possible.

If you are a landlord or tenant, we can assist you in negotiating rent relief arrangements under the Commercial Tenancy Relief Scheme.

Property

While COVID-19 and recent stage lock-down measures have caused a major disruption to the way individuals and businesses operate, the property market and all property transactions continue to operate as usual.

All property and conveyancing transactions are still being processed as normal, and we continue to settle property transactions in a timely manner.

Please feel free to forward to our office a copy of the Contract of Sale if you would like advice before signing a Contract.

We can also assist with a range of property and conveyancing transactions, including residential conveyances, subdivisions and consolidations, easements, caveats, leases and contract, aged care facility contracts and advice and mortgage document review.

Litigation

Work in litigation has not slowed down, with the Courts in Victoria now transitioning to online hearings and appearances by phone or video conferencing.

The filing of Court documents, to issue or defend an application, can also be done online via the Courts’ filing portal.
